Abstrak

The State Administrative Court has the duty and authority to examine, decide and resolve State Administration disputes. Disparity occurs because juridical and non-juridical considerations are different in the three cases the. In practice in the field, there are disparities in Tata Court decisions State Efforts to annul marriage certificates. The research objectives of this thesis are as follows, 1) To analyze disparities in State Administrative Court decisions in examining and adjudicating the annulment of the marriage act, 2) To analyze legal certainty in disparities in court decisions State Administration in the matter of marriage deed annulment. Research methods used in This research is a normative research method, namely legal research This is done by reviewing library legal materials by searching regulations related to the problem being studied. Conclusion: 1 Disparity in State Administrative Court decisions in cases the annulment of a marriage certificate creates legal uncertainty within application of laws and regulations in Indonesia apart from that giving rise to differences or inequalities in decision making, often occurs in the justice or law enforcement system. 2. Certainty law with the disparity in the decisions of the State Administrative Court in Marriage certificate annulment cases give rise to legal uncertainty so that it cannot provide justice to the community. For that is a necessary way out to ensure that it doesn't happen again in the future disparity in State Administrative Court decisions in deed cancellation marriage cases.
